My Boyfriend is in Jail. Will This Affect His VA Benefits?
“My boyfriend is in jail. Will this affect his VA benefits?” –Jurlean G.
Hi Jurlean,
The good news is that he will keep his VA benefits if he is not actually convicted of a crime. We have great attorneys here who understand the needs of our vets and we utilize veteran-related mitigation and services when applicable. It is important to remember that if he is in Veteran’s Treatment Court, substance abuse/mental health treatment, probation, or other diversion programs he will NOT lose benefits. If he is convicted of a misdemeanor and sentenced to more than 60 days in jail, your loved one will lose his VA pension benefits on the 61st day of incarceration and if he is convicted of a felony and sentenced to more than 60 days in jail, he will lose his VA pension or up to 90 percent of his VA disability benefits on the 61st day of incarceration. They can be reinstated fairly easily, however.
