Lawmakers Ask Supreme Court to Weigh Veterans’ Rights under Arbitration – HR Drive
Twenty members of Congress are asking the U.S. Supreme Court to overturn a lower appeals court ruling that rejected a Navy Reservist’s claim. The plaintiff in that lawsuit was suing his employer for firing him before his deployment to Afghanistan. His employer claimed that he was terminated for deficient performance. The Court is posed with determining whether a civial employer can force a military reservist”s unfair firing claim, filed under the Uniformed Services Employment and Reemployment Rights Act (USEERA), to be resolved by arbitration.
